Evnex Limited (we, us or our) provides electric vehicle charging solutions in New Zealand and Australia.

In operating our business we collect, store, process, use and disclose personal information belonging to a range of people including our customers and suppliers. We are committed to protecting your personal information.  When we refer to personal information, we mean information about an identifiable individual as defined in the New Zealand Privacy Act 2020 (Personal Information).

When dealing with Personal Information, we will comply with this Privacy Policy and the applicable privacy laws in Australia (the Australian Privacy Act 1988) and New Zealand (the New Zealand Privacy Act 2020) (together Applicable Privacy Laws).

This Privacy Policy sets out how we handle the Personal Information that we may collect through our website at evnex.com including our enterprise cloud service CP Link (Website) and through our mobile app (App) or when you otherwise interact with us or our products (Products) or services (Services).

This Privacy Policy applies to all Personal Information submitted to or collected by us in New Zealand and in Australia. By submitting Personal Information to us (including when purchasing or using our Products), you accept the terms of this Privacy Policy, and you consent to our collection, use, disclosure, and retention of Personal Information as described in this Privacy Policy.

If you provide us with any Personal Information that relates to another individual, you must ensure that you have all necessary consents from that individual to allow us to use that information in accordance with this Privacy Policy.

We may obtain a wide range of personal information from you as a result of your use of the Website, and/or when you otherwise interact with us or our Products or Services. The Personal Information we collect includes but is not limited to:

your name, email address, physical address, phone number and/or other details if you provide these to us;

your installation connection point number (if you are a customer in New Zealand) or your national metering identifier (if you are a customer in Australia), together with your electricity retailer and tariff type;

your credit card or billing details if you pay any charges for our Products or Services;

details relating to your charger installation and equipment including charger location and serial number;

charger usage, performance, and electricity metering data including charger plug-in and unplug times, charging schedule, Charge Now activation, charge session start/stop time, energy delivered (kWh) during a charge session and periodic readings of current, voltage and frequency supplied;

any other personal information you otherwise provide to us.

The Personal Information we collect may be collected in a number of ways including but not limited to:

when you browse our Website, order our Products, sign up for and use our Services or download and use our App;

when you email us, send us messages via our Website, or phone us; and

when our Product is installed at your property, at the time of installation and at any other time we are required to visit your property or otherwise support our Product and/or deliver our Services.

We use cookies, web beacons, or device identifiers (which may include unique IDs, platform type and version (e.g., iOS or Android), hardware and processor information to identify your device and/or your Product so we can:

track usage patterns for our Website, Products and App;

customise your preferred use of the Website, Products and App; and

deliver a better experience to you and to improve the Website, Products and App.

How We Use The Personal Information We Collect

We may use your Personal Information for a variety of reasons and purposes in accordance with the Applicable Privacy Laws, including but not limited to:

responding to your enquiries about us or our business;

measuring, managing, monitoring, supporting, developing and improving our Website, our Products, our Services and our App;

contacting you about the Website, our Products, our Services or our App;

We may use anonymised aggregated data (Anonymised Aggregated Data) to improve the quality of our Products and Services and for statistical and market research purposes. Anonymised Aggregated Data is information that is not associated with any individual person.  We may use this data in anonymised aggregate form as a statistical measure, but not in a manner that would identify any individual personally.

Who We Disclose Personal Information To

We will not sell, lend, or trade Personal Information to any third party other than as described in this Privacy Policy.

We will only disclose your Personal Information for the purposes for which it was collected, and for directly related purposes (including those required by the Applicable Privacy Laws).

taking and fulfilling orders made by you for Services or Products

conducting surveys about our business

enabling third parties to provide services to us in connection with the Website, our Products, our Services or our App and/or to operate our business

improving our Product and Service offerings to our customers, improving our impact on the environment, and optimising the electricity landscape in New Zealand and/or Australia.  Please note that this may involve sharing Personal Information and/or Anonymised Aggregated Data with electricity retailers and other related third party grid partners (including but not limited to distributed energy aggregators and electricity distribution businesses involved in the electricity supply industry) to help with understanding and improving network performance, and managing demand/load on the network .  In some instances, we may charge those third party grid partners a fee for providing them with Personal Information and/or Anonymised Aggregated Data, to help us continue offering our business to you;

when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request, and

as otherwise expressly permitted under this Privacy Policy.

Transferring Personal Information Outside New Zealand

We will primarily collect and process Personal Information in New Zealand and Australia.  

The Personal Information that we collect is stored on our servers. The servers are physically located in Sydney, Australia.

However, we may transfer your Personal Information to third parties outside New Zealand or Australia for the purposes set out in this Privacy Policy.  If at any time we need to send Personal Information outside of New Zealand or Australia to an overseas agency that may use the information for its own purposes, we will:

a) take steps to ensure that we believe on reasonable grounds that the overseas agency receiving the Personal Information is subject to privacy protections that, overall, provide comparable safeguards to those provided under the Applicable Privacy Law;

b) enter into a binding contractual agreement with the overseas agency receiving the Personal Information confirming that it will protect the Personal Information in a way that, overall, provides comparable safeguards to those provided under the Applicable Privacy Law; or

c). obtain the express authorisation of the individual concerned to disclose their Personal Information overseas after expressly informing them that the overseas agency may not be required to protect the information in a way that, overall, provides comparable safeguards to those provided under the Applicable Privacy Law.

You acknowledge and agree to such international transfers of your Personal Information for the purposes set out in this Privacy Policy.

Security of your Personal Information

We take reasonable precautions to make sure that we keep your Personal Information secure. However, because the internet is an open network, we cannot warrant or guarantee that your Personal Information is safe from unauthorised access or use.

We may store your Personal Information on computer systems operated by third parties. We will take reasonable precautions against unauthorised access and disclosure by those third parties.  Where you have authorised us to disclose your Personal Information to a third party in accordance with this Privacy Policy, we will take reasonable precautions to ensure your Personal Information is treated securely by them and maintained in accordance with this Privacy Policy. However, ultimately their use and maintenance of your Personal Information is outside our control and we accept no responsibility or liability for such third party use.

We take website and credit card security seriously and always endeavour to provide a secure platform on which to make online payments. Our Website is secured by [e.g. SSL certificates, encryption methods]. We use a leading online payment provider and your credit card data is not stored by us.

Communications With You

We will send you emails throughout the ordering and purchasing process. If you have any post-sales enquiries we will communicate with you by email or phone.

We may send out promotional material by email in our newsletters promoting material related to Evnex and our business.

We will preserve the content of any email you send us if we believe we have the legal requirement to do so, or for reasonable record keeping. Your email message content may be monitored by us for trouble shooting or maintenance purposes or if any form of email abuse is suspected.

From time to time we may send you, and you agree to receive, emails and other promotions relating to Services or Products offered by us and our related companies, partners and customers.

You may opt out of receiving those emails and other promotions at any time by following the opt out instructions provided in the relevant communication.

Accessing Or Correcting Your Personal Information

You may request access to your Personal Information that is held by us at any time by notifying us in writing. We will use reasonable endeavours to provide this Personal Information as soon as reasonably practical.

If you believe any of your Personal Information is incorrect or inaccurate you may request us to correct it at any time.

Notifiable Privacy Breaches

If your Personal Information is involved in a privacy breach which we reasonably believe has caused or is likely to cause serious harm to you (“a Notifiable Privacy Breach”), we will inform you and recommend what steps you should take in response. We will also report a Notifiable Privacy Breach to the Office of the Privacy Commissioner in New Zealand or the Office of the Information Commissioner in Australia.

We may update this Privacy Policy from time to time. The current version posted on the Website will apply to your use of our Products, Services and the Website; the terms will also apply to our use and storage of your Personal Information.

The Website may contain links to third party websites or applications. We are not responsible for the privacy practices or content of third party websites or applications.
